Construction Law Section
The Dallas Bar Association Construction Law Section focuses on a broad range of legal and industry issues that arise in the context of public and private construction projects. We provide an excellent opportunity for continuing education and a forum for discussing and answering questions on construction law issues of all types. The Section hosts luncheons for its members on the first Thursday of every month at The Belo Mansion beginning at noon. Guests are welcome to join us to see what the Section is all about. Through luncheon seminars and its newsletter, the Section aims to keep its members abreast of developments and trends in construction law. The Section actively encourages its members to participate in pro bono projects which involve construction issues.

Meeting Schedule:
The section will have its monthly meeting on Thursday, May 3, 2012 at noon at the Belo Mansion. The speaker will be Cara Kennemer of Goins, Underkofler, Crawford & Langdon, LLC. Ms. Kennemer will be presenting a speech entitled “Tips on Avoiding Malpractice for the Construction Lawyer”. The presentation will focus on various perils that can be encountered by construction practitioners and the key strategies and day-to-day management tips that will help avoid malpractice claims and grievances. Attendees can earn ethics credit for attending this speech.
This section will have its June monthly meeting on Thursday, June 7, 2012. The speaker will be Andrew M. Gould of Wick, Philip, Gould & Martin. Mr. Gould will be presenting a speech entitled "Drafting, Enforcing and Challenging Non-Compete Agreements In Light of Light's Demise The New Face of Post-Employment Non-Competition Agreements in Texas." On June 24, 2011, the Texas Supreme Court wrote the next chapter regarding non-compete agreements in Texas. That case, Marsh USA Inc. and Marsh & McLennan Companies, Inc. v. Cook, appears to end various challenges practitioners faced since 1994 when the Court issued its opinion in Light v. Centel Cellular Co. of Texas. This presentation will discuss Marsh, its meaning and significance, and various strategies businesses are employing regarding non-competition agreements (and other restrictive covenants) in the post-Light era.

Announcement: The Section publishes a handbook titled "Texas Lien and Bond Claims Handbook" that is available for purchase. The Handbook is in its Sixth Edition. All six editions have been authored by Steven E. Kennedy, of McGuire, Craddock & Strother, P.C. and Fred Wilshusen, of Thomas Feldman & Wilshusen, LLP who generously gave of their time and effort to ensure this information would be available to the Bar. The handbook contains analysis of private and public lien claims and bond claims, the relevant statutes applicable to each claim and helpful pointers and forms.
